A second doctor took the stand to testify in the case of a man accused of killing an Alliston road worker.

On Friday, Dr. Julian Gojer agreed with a fellow doctor’s testimony that Marcello Fracassi has a sleep disorder called parasomnia.

"Everything that I have reviewed confirms in my mind that Fracassi has parasomnia," he said.

Gojer did not rule out the Crown’s claim that Fracassi was too drunk to drive when he fatally hit road worker Geoff Gaston in 2014. However, Gojer said given Fracassi’s medical and physical state it is more likely that he was sleep driving.

"The question is, was he sleepwalking or sleep driving on the day in question? I feel that it's highly likely he was in a state of sleep driving."

As to Fracassi's actions in the hours leading up the crash, which reportedly included a stop at a strip club and a restaurant, the doctor said "People can present as awake to the public, but will be in a state of sleepwalking."

Meanwhile, the Crown called its first witness, OPP Const. Michael Walton, who arrested Fracassi.    Walton testified he smelled alcohol on Fracassi when he questioned him at his home and said Fracassi denied that he drove himself home.

However, the defence still insisted Fracassi didn't remember the crash, pointing out that he didn't try to hide his vehicle, which displayed obvious evidence of the collision.
