The Crown didn't waste time on Wednesday asking a man accused of killing an Alliston road worker about his drinking and sleep driving defence.

Prosecutors suggested to the Barrie court that Marcello Fracassi was drink when he struck and killed Geoff Gaston in 2014.

"You had too much to drink to be driving, right?" asked the Crown attorney. "Yes, as a possibility" responded Fracassi.

Fracassi has pleaded not guilty to impaired driving and dangerous driving.

On Wednesday he testified that after leaving a concert in Toronto that night, he fell asleep, and does not remember what happened after that, including the fatal crash.

The Crown argued that the amount of alcohol Fracassi says he drank couldn't have been true because he blew over well over the legal limit when he was taken into custody.   

Fracassi replied, "I did track what I drank specifically that night until I fell asleep."

Fracassi told the court he has instances where he drives and can't remember parts of the trip. The Crown didn't buy his sleep driving defence, saying he was too drunk to drive and dozed off on the road.

The Crown said surveillance video from the night in question shows Fracassi swerving to avoid a truck after hitting Gaston.

Fracassi's mother was also called to the stand. She told the court that sleep walking runs in the family, and there were times when Fracassi's father could be seen standing on a table working with no tools in his hands while asleep.

Fracassi's wife Rachel was also called by the defence. She was very emotional during her testimony, as the Crown was outlining details of her husband's arrest and the night in question. 

She told the court that Fracassi often talked in his sleep and would go to the bathroom in unusual places during the night. The Crown suggested it was all the result of a drinking problem.

Rachel Fracassi was also asked about the current situation with her husband. She told the court that he doesn't drink hard liquor anymore, but said he's still having what she called "episodes.”

A doctor is expected to be called to the stand on Thursday for more testimony about Fracassi's medical condition.
