The jury in the Andrew Mixemong murder trial came back to the judge with a question on Thursday afternoon.
The question was about the idea of intent. The jury asked if they had to conclude that one of the suspects, Jessy Herlichka, specifically knew his actions would likely cause Mixemong’s death or did they have to conclude that any normal person would know similar actions would kill someone.
The judge responded by repeating a section of his charge to the jury which stated that in order to find Jesse Herlichka guiltily the crown had to prove beyond a reasonable doubt one of two things: either that Jessy Herlichka meant to kill Andrew Mixemong or that he meant to cause bodily harm that he knew was so serious it would likely kill him.
The jury is also deliberating the charges against Paul McClung. There are three options for McClung, guilty of either second-degree murder or manslaughter or not guilty. The jury will have to decide whether McClung knew Herlichka intended to kill Mixemong and intended to aid and abetted him in committing murder.
The jury is expected to continue deliberating into Thursday evening and will be back in court on Friday.
