The first police officer to arrive on the scene after Deena Brooks was shot to death testified Wednesday.
OPP Constable Adam Pinn told the jury when he first arrived on the scene the front door was unlocked.
“I opened it and saw a female party lying on the ground—lying on her back,” Pinn testified.
Pinn told the court he noticed a handgun just feet away from Deena Brooks body and moved it out of the way with his foot.
Pinn described to the court how he found Brooks’ husband, Mitchell who is facing a first-degree murder charge.
“He crouches in the doorframe and looks into the backyard. He had a cordless phone in his hand—he puts his head in his hand,” Pinn testified.
It was on that night in May 2013 when Mitchell Brooks called 911 after Brooks was shot. The jury has heard the 911 call earlier in the trial.
The Crown contends that Brooks killed his wife in a deliberate act after she told him she wanted to leave him.
Brooks initially said he and his wife were having an argument over a handgun when Deena was shot. He also told police he meant to kill himself.
Pinn testified that when he asked Mitchell Brooks what happened, Brooks replied “It should have happened to me, I wanted out.”
The officer also told the court Brooks was wearing construction pants that were covered in blood.
Pinn testified about Brooks behaviour once he was taken to the police station for questioning. The officer told the jury that Brooks stared straight into the wall and nodded his head back and forth, but didn’t go to sleep.
The six week trial will take Thursday off and will resume on Friday.
