The trial of a woman accused of failing to care for her horses moved into day four in Owen Sound court today.
The OSPCA has charged against Lynda Smith after seeing the condition of horses at her farm in Markdale last year.
Today, CTV Barrie news reporter Roger Klein was called to testify.
Klein shot video footage on Smith's farm in March 2013. He was there as three women, calling themselves horse rescuers, went on to the property to check on the condition of Smith's horses. Smith had requested the video be entered as evidence in the trial. Smith, who is defending herself, asked Klein if he had taken the video and he confirmed he had.
She also asked if he had witnessed any of the three women on the farm remove water or feed, which had been left out for the horses and whether he had seen anyone affect the welfare of the horses.
Klein answered no to those questions.
The Justice of the Peace then ruled the video wouldn’t be entered as evidence.
Smith is facing charges under the OSPCA Act of failing to provide care to several of her horses and failing to comply with an OSPCA order.
The case is expected to resume tomorrow.
