A suspended Barrie Police officer will learn his fate today.
Constable Jason Nevill arrived at the courthouse this morning after 9:00. He did not speak to CTV News on his way in.
He is due to be sentenced for assaulting a man who he was arresting outside of the Bayfield mall back in November of 2010.
Security video taken at the Bayfield mall on the night of the incident played a key role in the case.
The video shows Constable Nevill in a violent confrontation with 25 year old Jason Stern of Barrie.
It happened after Stern was being questioned about a broken Christmas ornament inside the mall.
Nevill claimed that he was defending himself, and that Stern was intoxicated.
Stern has filed a $1 million lawsuit against Nevill, Barrie Police, the shopping mall, and two security guards who were present on the night in question.
Nevill is a 14-year veteran of the Barrie Police force, and Barrie Police Chief Kimberley Greenwood has called the attack a “rare incident”.
