Lawyers agreed on Friday that a Newmarket man, who pleaded guilty in the death of his young son, should be sent to prison for 10 years.

Mario Wint sat quietly in the prisoner’s box, as his lawyer told the court that his client "loved his son."

"Whatever sentence is imposed the most crushing sentence is the one the burden he will have to carry for the rest of his life," said lawyer Steven Skurka.

The defence and Crown agree that Wint should be sentenced to 10 years. With credit for time already served, it would equal out to eight years.

The Crown wants Wint to serve at least five years before he's eligible for parole.

"This was a horrific crime with devastating consequences," Crown attorney Marcy Henschel told the court. "It was a savage attack on a helpless child." 

Wint punched his two-year-old son Ty more than once "with significant force" in the abdomen, causing devastating internal injuries, which resulted in the toddler's death.  Wint later pleaded guilty to manslaughter.

Wint waited four hours before calling 911 for help on the day of the attack, but he lied to several people about what happened to his son.

"He knew he hurt him and delayed calling for help because he was afraid he would get in trouble," Henschel said.

Victim impact statements were read out in court, but a publication ban prevents those details from being shared.

When the judge asked if Wint had anything to say, he responded “I would give my eye, my arm to bring him back, but I can't. I will do my time and be a better person." 

Wint will be back in a Newmarket court on May 24 for sentencing.
