The evidence shown at Jaspal Singh Sidhu’s second-degree murder trial

CTV News has obtained the evidence presented at the second-degree murder trial of Jaspal Singh Sidhu.

His father, 68-year-old Balbir Singh Sidhu, was found dead in their Guelph home on Feb. 28, 2023.

Video shown in court

On Monday and Tuesday, video from the body-worn cameras of two Guelph Police officers was shown to the jury.

Jaspal Singh Sidhu is seen opening the door of the Hands Drive home. He is bent over and then sits on the floor while talking to the officers.

Blood can be seen on his pant leg.

“Wow, what happened to you?” said one of the officers. “What happened to you? What happened to your leg? Did you get stabbed?”

Jaspal Singh Sidhu replied: “My dad tried to kill me, yo.”

One of the officers then tied a tourniquet around his leg as a precaution. Later, after an examination by paramedics, it was determined it was not his blood.

“Where’s your dad?” an officer asked.

Balbir Singh Sidhu’s feet could be seen from the entrance.

The officer then called into the home: “Hands up, hands up.”

When there was no reply, he asked Jaspal Singh Sidhu: “Where is he?”

To his partner, the officer said: “He’s sitting on the floor over there.”

Then to Jaspal Singh Sidhu on the floor: “Does he have injuries?”

While officers continued to call to Balbir Singh Sidhu, Jaspal Singh Sidhu repeated: “I just countered, I just tried to protect myself, I’m sorry.”

He also claimed he had blacked out.

Balbir Singh Sidhu was found lying on the floor with a knife sticking out of his chest, which he was holding by the handle. A second knife was lying broken beside him.

Tenants testify

Two tenants who lived in the basement of the home testified they heard yelling and arguing leading up to the stabbing.

Autopsy results

Forensic pathologist Dr. Daniel Smyk, who performed the autopsy on Balbir Singh Sidhu, took the stand on Wednesday.

He said the victim had eight stab wounds. Five of them were on the side of his body, two in the back and one in his chest.

Smyk told the court that two of the wounds would have been fatal.

The jury was also shown photos, including the two knives recovered from the scene.

Photos inside the home

On Wednesday, the jury heard from forensic identification officer Chadd McNeilly, with the Guelph Police Service.

He presented photos taken inside the home during the police investigation.

The photos showed LCBO bags, an empty can, a bottle missing 7.7 ounces of alcohol and cannabis-related items inside Jaspal Singh Sidhu’s bedroom.

More forensic evidence

Tonya Hackenbrook, an expert in bloodstain pattern analysis with Peel Regional Police, testified on day four of the trial that Balbir Singh Sidhu’s blood was found on the blade and handle of both knives.

Blood was also found in four rooms in the home: the foyer, kitchen, hallway and dining room.

In the agreed statement of facts, the Crown and defense agreed that all of it belonged to Balbir Singh Sidhu.

The final witness on Thursday was Renata Dziak from Ontario’s Centre of Forensic Sciences.

She had examined a sheath found in the home’s kitchen drawer which matched the blue knife in Balbir Singh Sidhu’s chest.

Dziak said she found no blood on it but the “DNA profile was a mixture of DNA from three individuals.”

“Both Jaspal and Balbir could not be excluded,” she told the court.

The defense is expected to cross examine Dziak on Friday.
