Jane Fuller broke down on the stand on Monday, as she recounted what happened the morning Geoff Gaston was struck and killed by a vehicle in Alliston.

Fuller told a Barrie court she was painting parking spot lines with Gaston on Victoria Street on June 20, 2014. She testified that Gaston was lining up the paint machine and was about to lay a pylon when she and then Gaston were hit.

"I got hit from behind," Fuller said. "I remembering taking a step after I got hit and turning toward Geoff – it was too late. He had already been hit."

She told the court she tended to Gaston, saying “I checked to see if Geoff had a pulse and I couldn't find one.”

She also testified she never heard the vehicle that hit them, didn't see it coming, and didn't see it hit Gaston.

Marcello Fracassi was the man behind the wheel and has pleaded not guilty to seven charges including impaired driving, failing to remain at the scene and dangerous driving causing death.

Court has heard his blood alcohol level was above the legal limit when he was arrested. On the stand Tuesday, one of Fracassi's friends said Fracassi was drinking that night at a concert.

The defence says Fracassi was "sleep driving" at the time, and suffers from a disorder that can create an altered state of mind. 

During proceedings, the court heard the job required the crew to be in the traffic lane at times and they that were wearing reflective clothing issued by the town.

The crew had a "men at work" sign about 98 meters from where the incident happened.

During cross examination, the defence suggested Gaston and Fuller should have waited for a third road crew member who was nearby before they started painting.

The defence also suggested the crew didn't follow their training by failing to place more warning signs and also by not turning on their work trucks flashing lights. 

At one point, the Crown showed the court the work uniform Gaston was wearing and made it an exhibit. Gaston's widow began to break down, as Fracassi closed his eyes and covered his face with his left hand.

The trial continues on Wednesday.
