A jury began deliberating on Tuesday in the case of an Orillia couple charged with failing to provide the necessitates of life for a 76-year-old woman.

Dianna Davy and her husband James Davy were charged in the case of Dianna’s mother Viola Simonds.

Court heard that Simonds was found by paramedics lying nearly naked with a broken hip, and covered in vomit, urine, and feces.

The trial has centered around the conditions Simonds was found in, and a “breakdown” in communication between the various parties responsible for her care.

The defence has argued that the Davys were carrying out Simonds’ wishes to stay out of a long-term care home.

The couple have been charged separately, so the jury must come to two separate verdicts.

They began their deliberations late Tuesday afternoon and retired for the night with no verdict.

Deliberations will resume Wednesday morning.
