Charges against an OPP officer in Midland have been withdrawn.

OPP Const. Mark Lund was facing an obstruction of justice charge, but the Crown had that charge thrown out in a Midland court on Thursday. The Crown did not provide a reason.

Police had said the incident that led to the obstruction charge happened while Lund was off duty, but they didn't release any specific details.

Lund is the father of Shayne Lund, who was recently sent to prison for sex crimes against children.

Lund was not in court for the development. His lawyer wouldn't comment on the allegations, but said there wasn't enough evidence for a conviction.

“From the very beginning when I saw the evidence against Mr. Lund I was scratching my head,” says lawyer Bernard Cugleman. “You can't charge somebody on the basis of this evidence. Obviously cooler heads prevailed and the Crown Attorney's Office realized it didn't have a case."

Cugleman says Lund’s reputation in the community as a police officer is damaged.

The OPP would not comment on the matter and would only say that Lund is still a member of the force. Both his lawyer and the OPP would not say if he would be returning to active duty.

The OPP have never said if Lund's obstruction charge was connected in any way to his son’s case.
